Notice of extension of investigation

The Canada Border Services Agency (CBSA) has today extended the preliminary phase of the investigation into the alleged injurious dumping of certain oil country tubular goods from Austria.

The Special Import Measures Act (SIMA) provides that, under normal circumstances, the preliminary stage of the investigation shall be completed within 90 days of the date of initiation. Subsection 39(1) of SIMA allows for the period of 90 days to be extended to 135 days when circumstances exist that make it unusually difficult to decide within 90 days whether to make a preliminary determination of dumping or to terminate the investigation with respect to some or all of the goods.

In this investigation, in order to help alleviate the pressures brought on by the COVID-19 pandemic to interested parties, the CBSA granted extensions to the deadlines for providing information where requested. The extensions provided to interested parties have made it unusually difficult for the CBSA to fulfill a complete review of the submitted information provided by the extended deadlines and to make a preliminary decision within 90 days.

As a result, the period has been extended to 135 days, pursuant to subsection 39(1) of SIMA. Consequently, the decision to issue a preliminary determination of dumping or to terminate the investigation with respect to some or all of the goods will be made on or before November 19, 2021.
